Back in October 2025, Pressenza reported on the refusal of Poland to extradite a Ukranian wanted by German authorities in connection with the sabotage of the Nordstream pipelines:

Judge Dariusz Lubowski ordered the release of the suspect whose extradition Germany had demanded due to his alleged involvement in the Nord Stream attack. According to him,
“Blowing up of critical infrastructure…during a just, defensive war…is not sabotage, but rather military actions…which under no circumstances can constitute crimes.” He also questioned Germany’s jurisdiction over international waters and said that only the Ukrainian state bears responsibility if it indeed ordered the attack.
Strange how the 'military actions' of the Russians in blowing up infrastructure in Ukraine are reported as if 'crimes' against the civilian population.
Presumably his logic is that this is because Russia 'started it' so it's a just 'defensive war' by the West and an unjust offensive war by the Russians.
One wonders what would have happened if the pipelines sabotaged were supplying the USA - supposedly another non-combatant in the war like Germany? It seems highly likely the extradition would have happened immediately. Or else.
And if Germany doesn't have jurisdiction over 'international waters' then no-one else does either so no-one can complain if lots of undersea cables are cut and pipelines damaged in future conflicts as they don't have jurisdiction either.
If only 'states' bear responsibility for crimes like this then presumably soldiers who kill and rape people their state calls 'terrorists', say, are exonerated because it's the state that is to blame for giving carte-blanche to its forces to kill terrorists?
It's all just nonsense.
As Pressenza goes on to report:
For as compelling as some might consider Lubowski’s points to be, Hungarian Foreign Minister Peter Szijjarto disagreed, posting on X that “according to Poland, if you don’t like an infrastructure in Europe, you can blow it up. With this, they gave advance permission for terrorist attacks in Europe. Poland has not only released but is celebrating a terrorist—this is what European rule of law has come to.” That’s a compelling point too even if one disagrees that Ukraine is guilty and blames the US like Russia does.
